Terms of Service

These Terms of Service ("Terms") govern your use of the SewReady platform ("Service"), operated by SewReady ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Service Description
SewReady is a software-as-a-service (SaaS) platform that provides alteration and sewing shops with digital order management, customer communication, online ordering, and business operations tools. The Service is delivered via web browser and does not require software installation.
2. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old or the legal age of majority in your jurisdiction.
- One person or business entity may maintain multiple shop accounts.
- You are responsible for all activity that occurs under your account.
3. Subscription Plans & Billing
3.1 Plans
- Storefront (Free): Basic web presence with shop information, services display, and contact form. Free forever, no credit card required.
- Online Orders ($79/month): Adds online ordering, customer accounts, order tracking, employee management, inventory, calendar, and receipt printing.
- Full Shop ($149/month): Adds SMS notifications, email notifications, automated alerts, SOP library, driver coordination, and analytics.
3.2 Billing
- Paid plans are billed monthly through our payment processor (Snipcart).
- Charges are non-refundable except as described in Section 7 (Cancellation).
- We may change pricing with 30 days' notice. Existing subscriptions continue at their current rate until the next renewal.
- Failed payments may result in temporary service suspension after a 7-day grace period.
4. Data Ownership
- Your Data: You retain full ownership of all data you or your customers enter into SewReady, including orders, customer information, photos, and business records.
- Data Export: You may export your data at any time via the Settings page (CSV format).
- Our Use: We access your data only to provide the Service, troubleshoot issues, and generate anonymized, aggregated analytics. We will never sell your data to third parties.
- Data Portability: Upon account termination, we will make your data available for export for 30 days.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to the Service or other accounts.
- Upload malicious code, viruses, or harmful content.
- Use the Service to send unsolicited messages (spam) via SMS or email features.
- Resell or redistribute the Service without written authorization.
- Interfere with the Service's infrastructure or other users' access.
- Use automated tools to scrape data from the Service.
6. SMS & Email Communications
- SMS and email notifications are sent on your behalf to your customers using third-party providers (Twilio for SMS, Resend for email).
- You are responsible for obtaining appropriate consent from your customers before sending notifications.
- Standard messaging rates may apply to SMS recipients.
- You must comply with all applicable laws regarding electronic communications, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
7. Cancellation & Refunds
- You may cancel your subscription at any time through the Settings page or by contacting us.
- Cancellation takes effect at the end of the current billing period. No partial refunds for unused time.
- The Storefront tier remains available after cancellation of a paid plan — your shop page stays live.
- Refunds may be issued at our discretion for billing errors or service outages exceeding 24 hours.
- After cancellation, your data is retained for 30 days, then permanently deleted.
8. Service Availability
- We target 99.9% uptime but do not guarantee uninterrupted service.
- The Service is hosted on Cloudflare's global infrastructure.
- Planned maintenance will be communicated in advance when possible.
- We are not liable for downtime caused by third-party providers, internet outages, or force majeure events.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Service is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not responsible for the accuracy of data entered by you or your customers.
- We are not liable for SMS/email delivery failures caused by third-party providers or carrier issues.
10. Intellectual Property
- SewReady, its design, code, and branding are our intellectual property.
- You retain ownership of your shop branding, logos, and content uploaded to the platform.
- You grant us a limited license to display your content as part of delivering the Service (e.g., showing your shop name on your storefront page).
11. Indemnification
You agree to indemnify and hold harmless SewReady from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Modifications to Terms
- We may update these Terms at any time. Material changes will be communicated via email or in-app notification.
- Continued use of the Service after changes constitutes acceptance.
- If you disagree with updated Terms, you may cancel your account.
13. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Cumberland County, North Carolina.
